O R D E R

Aggrieved by the rejection order passed by the respondent thereby rejecting the application of the petitioner seeking issuance of legal heirship certificate in respect of his late mother viz., Sundharammal, the petitioner is before this Court.

2. Mrs.Anitha, learned Special Government Pleader takes notice on behalf of the Respondent.

3. It is the case of the petitioner that he is the adopted son of one Sundarammal and Rathinasamy who predeceased her. After the demise of his adoptive parents, the petitioner filed a suit in O.S.No.106 of 2024 on the file of Learned District Munsif Court, Sathyamangalam, seeking declaration of his adoption as well as the legal heirship status of the petitioner with the deceased. The said suit was decreed in favour of the petitioner on 29.04.2024. Subsequently, the petitioner submitted an online application seeking issuance of legal heirship certificate in respect of his deceased mother Sundrammal. However, the said application was rejected on the ground that the petitioner is not the legal heir of the deceased Sundarammal. Aggrieved by which, the present 2/5

Writ Petition has been filed.

Learned counsel appearing for the petitioner submitted that the rejection of the petitioner's application for issuance of legal heirship certificate is wholly contrary to the guidelines and procedures issued in G.O.Ms.No.110 dated 13.03.2024. Further, the respondent has failed to consider the decree in favour of the petitioner declaring his adoption as also the legal heirship status of the petitioner with the deceased. Therefore, the rejection order impugned is liable to be set aside.

Learned Special Government Pleader appearing for the respondents fairly submitted that the impugned order passed by the respondent is bereft of any particulars and therefore, this Court may set aside the same and remand the matter back to the respondent for fresh consideration and that the petitioner's application will be considered on the basis of the decree passed in O.S.No.106 of 2024 dated 29.04.2024 and G.O.Ms.No.110 dated 13.03.2024.

Recording the submission made by the learned Special Government Pleader, the impugned order passed by the respondent is hereby set aside and the matter is remanded back to the respondent for fresh consideration. The respondent is directed to consider the petitioner's application seeking issuance of 3/5

legal heirship certificate in terms of the decree passed in O.S.No.106 of 2024 dated by the Learned District Munsif Court, Sathyamangalam as also the G.O.Ms.No.110 dated 13.03.2024 and passed appropriate orders on merits and in accordance with law within a period of three (3) weeks from the date of receipt of a copy of this order.

7. The Writ Petition is allowed in the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 11.11.2025 Index : Yes / No Speaking Order / Non-speaking order Nhs To The Tahsildar, Sathyamangalam, Erode District.
