This Criminal Revision Case is filed under Section 438 r/w. 442 of BNSS, 2023 praying to set aside the order dated 07.08.2025 passed in Crl.M.P.No.6843 of 2025 by the learned II Metropolitan Magistrate, Egmore in Crime No.24 of 2025.

ORDER
This Civil Revision Case has been filed by the petitioner seeking to set aside the order dated 07.08.2025 in Crl.M.P.No.6843 of 2025 passed by the learned II Metropolitan Magistrate, Egmore.
2. The brief facts of the case are that the petitioner is one of the victims in Crime No.24 of 2025 on the file of respondent Police. One Mr.Z.Basal is an accused in Crime No.24 of 2025. The said accused cheated the petitioner by making a false promise to the petitioner that he would arrange a job at Secretariat to petitioner and received a sum of Rs.6,00,000/- from petitioner. Similarly, the accused had obtained money from two other persons viz., Mr.Mohammed Asan & Mr.Sadiq Hussain and cheated them too. Therefore, the said Mohammed Asan lodged a complaint to the respondent Police. Based on the complaint given by Mohammed Asan, respondent Police registered a case in Crime No.24 of 2025. During the course of investigation, respondent Police seized Rs.6,50,000/- Cash, 90 grams of Gold Ornaments and 250 Grams of Silver from the accused. 2/7
Subsequently, petitioner filed a petition in Crl.M.P.No.6843 of 2025 before the learned II Metropolitan Magistrate, Egmore for return of the property valued at Rs.6,00,000/-. However, the learned II Metropolitan Magistrate, Egmore vide order dated 07.08.2025, dismissed Crl.M.P.No.6843 of 2025 for the reasons that since two other victims in Crime No.24 of 2025 viz., Mr.Mohammed Asan & Mr.Sadiq Hussain have filed petitions for return of case property and investigation of case is at the initial stage, case property cannot be returned to the petitioner upon interim custody. Hence, the petitioner has filed the present Criminal Revision Case.

The learned counsel for petitioner submitted that two other victims in Crime No.24 of 2025 viz., Mr.Mohammed Asan & Mr.Sadiq Hussain had filed the petitions in Crl.M.P.Nos.5232 of 2025 & 6335 of 2025 respectively before the learned II Metropolitan Magistrate, Egmore for return of case property, but, the said petitioners were came to be dismissed on 07.08.2025. Thereafter, the said victims filed Crl.R.C.Nos.1904 of 2025 & 2103 of 2025 before this Court seeking to set aside the dismissal orders dated 07.08.2025 in Crl.M.P.Nos.5232 of 2025 & 6335 of 2025 passed by the learned II Metropolitan Magistrate, Egmore. This Court vide Order dated 24.10.2025, 3/7
disposed of Crl.R.C.Nos.1904 of 2025 & 2103 of 2025 respectively, directing the trial Court to hand over 90 grams of Gold Ornaments seized by the respondent Police to Mr.Mohammed Asan (petitioner in Crl.R.C.No.1904 of 2025) on condition that he shall not alienate the said Gold Ornaments and further, directing the trial Court to hand over Rs.2,50,000/- to Mr.Sadiq Hussain (petitioner in Crl.R.C.No.2103 of 2025) and Rs.4,00,000/- to Mr.Karthick (petitioner herein). Therefore, the learned counsel prayed that the present Criminal Revision Case may be disposed of on the terms as indicated in Order dated 24.10.2025 in Crl.R.C.Nos.1904 of 2025 & 2103 of 2025.
4. The learned Government Advocate (Crl.Side) appearing on behalf of respondent Police submitted that he has no objection for disposing of the present Criminal Revision Case on the terms as indicated in Order dated 24.10.2025 in Crl.R.C.Nos.1904 of 2025 & 2103 of 2025.

Taking note of the fact that this Court vide Order dated 24.10.2025 in Crl.R.C.Nos.1904 of 2025 & 2103 of 2025, already issued direction to the trial Court to hand over 90 grams of Gold Ornaments seized by the respondent Police to Mr.Mohammed Asan (petitioner in Crl.R.C.No.1904 of 2025); Rs.2,50,000/- to Mr.Sadiq Hussain (petitioner in Crl.R.C.No.2103 of 2025) and Rs.4,00,000/- to Mr.Karthick (petitioner herein), this Court is inclined to consider the request of learned counsel for petitioner and dispose of this Criminal Revision Case on the terms as indicated in Order dated 24.10.2025 in Crl.R.C.Nos.1904 of 2025 & 2103 of 2025.
7. Accordingly, this Criminal Revision Case shall stand disposed of on the terms as indicated in Order dated 24.10.2025 in Crl.R.C.Nos.1904 of 2025 & 2103 of 2025.
