O R D E R

The petitioner, who was arrested and remanded to judicial custody on 07.10.2025 for the alleged offence under Sections 137(2) of BNS, 2023 in Crime No.613 of 2025 on the file of the respondent police, seeks bail. 1/5

2. The allegation against the petitioner is that he had kidnapped the victim girl who is aged about 17 years, under the pretext of marry her. Later, he brought the victim back and she was secured. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is aged about 22 years and the victim girl is aged about 17 years. She accompanied the petitioner with her consent and immediately she was returned to her home within a day. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the the victim girl has been rescued and there is no previous case against him. However, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, the submissions made by both counsel, the victim girl has secured, there is no 2/5

previous case as against the petitioner, and the period of incarceration, I am inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties, for a like sum to the satisfaction of the Judicial Magistrate Court-IV, Tiruppur and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall report before the respondent police at 10.30 a.m for a period of three weeks and thereafter as and when required for interrogation;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down 3/5

by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 30.10.2025 Vv Note :
