Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order dated 26.07.2025 made in Letter No.E4/4268/Pa.P./TNSTC/Salem/2025 passed by the first respondent and quash the same and consequently direct the respondents to accept the request of the petitioner to retire him from service under voluntarily retirement scheme and relieve him from service. 1/5

O R D E R

This writ petition has been filed challenging the order dated 26.07.2025 thereby rejected the request made by the petitioner seeking voluntary retirement from service.

2. The petitioner is working as Selection Grade Conductor in the respondent Corporation. While being so, the petitioner met with an accident on 12.08.2024 and sustained spinal cord injury. Hence, petitioner was not able to continue his job and applied for medical leave. He was sanctioned medical leave till 11.01.2025. Thereafter, the petitioner was served with charge memo for continuous absence. Therefore, the petitioner submitted a representation seeking retirement on the ground of voluntarily retirement scheme. However, the said request was rejected on the ground that the petitioner was served with charge memo and charges are pending. Now the disciplinary enquiry is 2/5

completed and the petitioner was imposed with punishment of stoppage of increment for a period of two years without cumulative effect by an order dated 22.10.2025. Now no charge is pending.

3. In view of the above, the matter is remanded back to the first respondent for reconsideration and passing fresh orders since no charge is pending against the petitioner. The first respondent is directed to pass orders on the request made by the petitioner, if otherwise the petitioner is eligible for retirement under the voluntarily retirement scheme, within a period of four weeks from the date of receipt of a copy of this order.

4. With the above directions, the writ petition stands disposed of. No costs. Consequently, WMP No.47607 of 2025 is closed. 11.11.2025 Index: Yes/No Speaking/Non-speaking order mrn 3/5
