O R D E R

This Criminal Original Petition has been filed seeking to quash the proceedings in Crime No.212 of 2025 on the file of the first respondent police.

2. The petitioner is an accused in Crime No.212/2025 registered for the offences under sections 281 and 125(a) of B.N.S.

3. The case of the petitioner is that the petitioner's car was hit by a Government bus and thereafter, the Government bus hit the two wheeler driven by the second respondent/ de facto complainant. However, based on a complaint given by the second respondent/ de facto complainant, investigation is being conducted as if the petitioner had caused the accident. 2/5

Hence, the present petition has been filed seeking to quash the F.I.R.

Per contra, the learned Government Advocate (Crl.Side) would submit that based on the complaint given by the second respondent/ de facto complainant stating that the car driven by the petitioner dashed against the two wheeler driven by him and caused injuries to him and the pillion rider, one Jayasuriya, a complaint was registered. The petitioner himself has now given a complaint but no FIR has been registered. He would further submit that both the complaints are being investigated to find out who is at fault, but the petitioner is not co-operating in the investigation.

5. Considering the above submissions, this Court is of the opinion that only if the investigation is conducted, the person who is responsible for the accident will come to light. In such circumstances, the F.I.R. cannot be quashed. The respondent Police is directed to proceed with the investigation.

6. With the above observation, this Criminal Original Petition is closed. Consequently, connected miscellaneous petition is also closed. 3/5
