The petitioner, who was arrested and remanded to judicial custody on 21.12.2024, for the alleged offence punishable under Sections 307 of IPC @ 341, 302 r/w 34 of IPC in S.C.No.372 of 2024 on the file of IV Additional District Judge at Thiruvallur @ Ponneri, seeks bail.

2. The allegation against this petitioner, is that this petitioner is ranked as A2 in this case and earlier he was arrested and released on bail for the offences under Sections 341, 302 of IPC. He was regularly appeared in S.C.No.372 of 2024 on the file of the IV Additional District Judge, Thiruvallur @ Ponneri. He was absent on 30.10.2024 and NBW was also issued and executed on 21.12.2024 and there is no progress in the trial. Hence this case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person, and he has been falsely implicated in this case. He would further submit that though NBW was executed on 21.12.2024 only 2 accused are in this case, now both are in custody and no progress in the trial. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that though it is stated that the petitioner is having 8 previous cases, out of which several cases are registered under Sections 457, 380 of IPC. Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record 2/4

including the First Information Report.

Considering the submissions of the learned counsel on either side, and I have also call for the report from the trial Court and the report revealed that this petitioner was absconded for some period and thereafter he was arrested, he is in custody from 21.12.2024 and A1 was also jumped bail and now only he was secured and he is regularly appearing and the matter is posted for framing of charges on 18.11.2025. Considering the facts discussed above, I am of the view since both the accused are in custody, the trial has to be proceeded and if bail is granted it would stall the trial.

Accordingly, this Criminal Original Petition is dismissed with direction to speed up the trial and with liberty to the petitioner to renew the application after two months and subject to the case status, the petitioner is directed to present his argument and seek for bail 10.11.2025 rna To 1.The IV Additional District Judge at Thiruvallur @ Ponneri. 2.The Inspector of Police, M2, Madhavaram Milk Colony Police Station.
