ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.09.2025, for the offences punishable under Section 103 of BNS (Under Section 302 of IPC) in Crime No.293 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner herein along with other accused conspired together and called the deceased namely Sankar under the pretext of consuming liquor; that thereafter, they attacked the deceased on his head using beer bottles and stones, thereby the deceased sustained grievous injuries and died. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he is in judicial custody since 15.09.2025; that the petitioner is the friend of the deceased and on the alleged day of occurrence, the petitioner had consumed liquor along with the deceased and thereafter he left the place, therefore purely on suspicion, he was roped into this case; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for 2/4

bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and stated that there are totally 3 accused involved in this case and the petitioner is arrayed as A1; that the specific overt act against the petitioner joined hands with other accused and murdered the deceased, by attacking him on head with beer bottles and stones; and that the investigation of this case is pending.

Considering the submissions made on both sides, facts and circumstances of the case, grave nature of offence and taking note of the fact that the investigation of this case is not concluded, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 29.10.2025 stn 3/4
