The petitioners, who were arrested and remanded to judicial custody on 12.10.2025, for the offence punishable under Sections 77 of Juvenile Justice (Care and Protection of Children)Act, 2015 and Section 6, 24(1) of COTPA Act in Crime No.373 of 2025, registered on the file of the respondent, seeks bail.

The allegation against the petitioner is that on 01.10.2025 at about 07.00 a.m., on receipt of secret information regarding possession of banned tobacco products, the respondent conducted a search and they found that the petitioners were in possession of banned tobacco products namely 700 big pockets of Hans ( each 30 grams) and 900 big pockets of Cool Lip ( each 100.8 grams) for selling purpose and during the enquiry, the said accused stated that the accused Surendar Singh of Shevapet purchased the banned tobacco products from Bangalore and gave it to them to sell the same to shops. Further, based on the confession statement given by A1, the defacto complainant and his police team have seized 4000 big pockets of Hans ( each containing 300 grams) and 6000 big pockets of Cool Lip ( each containing 100.8 grams) from the house of one Muthaiya of Mechery Koppam. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that, petitioners were employees under A1 and they are migrant workers and they are not aware of the consequences of the contraband transported. Hence, he prays for grant of bail to the petitioners.

4. The learned Government Advocate (Crl. Side) submitted that, already A1 to A3 arrested and A4 is absconding in this case and further submitted that the value of the contraband is to the tune of Rs.19 lakhs. Hence, he vehemently opposed for grant of bail to the petitioners.

5. Considering the huge quantity of the contraband involved in this case and investigation in this case pending and if bail is granted, it would hamper investigation, hence this Court is not inclined to grant bail to the petitioner.
