Heard learned counsel for the petitioners and learned counsel for the 2nd respondent.

2.Learned counsel for the 2nd respondent has got serious objections in allowing the above petition.

3.The 1st petitioner would aver that on account of the road accident that took place on 18.08.2017, her husband succumbed to injuries and due to financial crisis, she was not in a position to mobilize funds to prefer Civil Miscellaneous Appeal.

Hence, there is a delay of 396 days occurred in preferring the appeal.

4.Accepting the reasons stated in the affidavit, this petition is ordered on the condition that the interest for the delay period shall stand waived.
