ORDER
This Court dismissed the earlier bail petition filed by the petitioners in Crl.O.P.No.27833 of 2025 dated 13.10.2025 on the following reasons. "5. Considering the facts and circumstances of this case, taking note of the fact that the sand was illegally taken from a river, thereby damaging the river bed, affecting the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioners."
2. The learned counsel for the petitioner submitted that the arrested accused has been released on bail and the petitioners are not having any previous cases. Hence, he prays to grant bail to the petitioners.
3. Though it is stated that other accused who are arrested and released on bail, this petitioner is indulged in a syndicate of illegally quarrying sand in small quantities, and later stores it in other places and sells it at huge profits, and thereby damages the ecology and river bed. It is also stated in the FIR that they
quarried the sand from the 'palar' river, which is a lifeline of various districts. Hence, if the anticipatory bail is granted, they will indulge in similar activities.
