ORDER

The petitioner, who apprehends the arrest at the hands of the respondent police for the alleged offence punishable under Sections 4 (1) (C) and 4(1)(A)

of the Tamil Nadu Prohibition (Amendment) Act 2024, in Crime No.179 of 2025, on the file of the respondent police, seeks anticipatory bail. 2.

The allegation against the petitioner herein is that, the petitioner was found in illegal possession of 40 bottles of TN IMFL Old Secret XXX Rum bottles each containing 180 ml; that on seeing the police, the petitioner fled away from the spot. Hence, this case.

Learned counsel appearing for the petitioner would submit that the petitioner is innocent and she has been falsely implicated in this case; that the petitioner had never committed any offence as alleged by the prosecution; and that the petitioner is ready to produce solvent sureties and to abide by any conditions that may be imposed by this Court and also undertakes to appear and to co-operate for the investigation, and prayed for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the petitioner has one previous case of similar in nature; and that the investigation of this case is pending. 5.

Considering the submissions made on both sides, gravity of

offence, the previous antecedents of the petitioner, the fact that the investigation of this case is pending and if the petitioner is granted anticipatory bail, she will indulge in similar offence, hence this Court is not inclined to grant anticipatory bail to the petitioner.
