ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 351(3) of BNS Act, 2023 r/w Section 4 of TNPHW Act, 1998 in Crime No.447 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation of the petitioner is that this petitioner is the husband of the defacto complainant and attacked the victim girl due to the domestic quarrel and threw stone on the pregnant women which caused severe injuries and also miscarriage. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned counsel for the Intervenor submitted that severe injuries has been caused to the victim and the petitioner has repeatedly attacked her and also caused miscarriage.

5. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the injured still in hospital and the victim suffered miscarriage and, he vehemently opposed to grant anticipatory bail to the petitioner.

6. Heard both sides and perused the materials available on record including the First Information Report.

7. Considering the submissions of the learned counsel on either side, the victim still in hospital, and this Court is not inclined to grant anticipatory bail to the petitioner.
