PRAYER; This writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Mandamus directing the 3rd respondent to issue work site inspection certificate and working condition of the plants and machinery certificate to the petitioner for the tender notification in Tender Notice No.44/2025-2026/HDO dated 07.10.2025 issued by the 2nd Respondent forthwith.

ORDER

The writ petition has been filed seeking a directions directing the 3rd respondent to issue work site inspection certificate and working condition of the plants and machinery certificate to the petitioner for the tender notification in Tender Notice No.44/2025-2026/HDO dated 07.10.2025 issued by the 2nd Respondent forthwith.

2. It is the case of the petitioner that the petitioner is a registered contractor with the respondent and it has been renewed periodically and the same is still in force. The second respondent has called for tender for certain item of work by tender notification dated 07.10.2025. The filled tender can be submitted through online on 31.10.2025 10.45 hrs.

3. It is the further case of the petitioner that the petitioner is owning working conditions of the plants & machineries also qualified for participating in the tender. Hence, the petitioner preferred an application to the third

respondent requesting to issue work site inspection certificate and working condition of the plants and machineries certificate to the the petitioner and the same has not been considered. Hence, the petitioner has filed the above said writ petition.

4. The learned counsel for the petitioner submitted that the third respondent being a public authority, who is duty-bound to process the application within the prescribed time-lines. The last date for submitting the application is 31.10.2025. Therefore, this Court may direct the third respondent to issue work site inspection certificate and working condition of the plants and machineries certificate to the petitioner by today itself.

5. The learned Special Government Pleader submitted that the certificates will be issued to the petitioner by tomorrow during the office hours.

6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

7. Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the third respondent to issue work site inspection certificate and working condition of the plants and machineries certificate to the petitioner by tomorrow itself before 5.00 P.M. The petitioner shall collect the same during office hours.
