ORDER

This Criminal Appeal has been filed as against the order made in Crl.M.P.No.1449 of 2025 dated 16.10.2025 on the file of the Principal Sessions Judge, Sessions Division of Ranipet District, thereby dismissing the petition for bail.

2.Heard the learned counsel appearing for the appellant and the learned Government Advocate for the respondents 1 and 2 and the 3rd respondent appeared in person and perused the materials placed before this Court. 3.The appellant is arrayed as 4th accused in Crime No.416 of 2025 on the file of the second respondent, registered for the offences punishable under Sections 194(1) of B.N.S.S.2023 and subsequently, it was altered into 103(1), 296(b), 238 of B.N.S. Act, 2023 r/w 3(2)(v) of Scheduled Caste/Scheduled Tribes (Prevention of Atrocities) Act, 1989.

4.Learned counsel appearing for the appellant would submit that the appellant has been falsely implicated in this case by the prosecution as if he along with other accused attacked the deceased with deadly weapons. He would submit that he has not committed any offence as alleged in the complaint and he is ready to abide any condition that may be imposed by this court. He would submit that he is in judicial custody from 18.06.2025 for more than six months. Accordingly, he prayed for granting of bail.

5. The defacto complainant appeared in person and raised objections.

6. Learned Government Advocate (Criminal Side) appearing for respondents 1 and 2 also raised objections stating that the deceased body was __________Page 2 of 4

found from the lake and this petitioner along with other accused beaten up the deceased with beer bottles and after having tied his hands and legs, he was thrown into the lake. Further would submit that no previous case is pending as against the appellant and the investigation is almost completed in this case. 6.After registration of FIR as against the appellant, the appellant was arrested and remanded to judicial custody on 18.06.2025. Thereafter, he had filed a bail application before the Principal Sessions Judge, Sessions Division of Ranipet District in Crl.M.P.No.1449 of 2025 and the same was dismissed. Hence, the appellant filed the present appeal seeking bail.

7. On receipt of notice, the defacto complainant appeared in person. On perusal of records, it reveals that now, the final report was filed, however, mother of victim raised objections and if he is released on bail, he may tamper the witnesses and hamper the investigation. Considering that and also considering the gravity of offence committed by the petitioner, this court is not inclined to grant bail to the appellant. Accordingly, the order made in Crl.M.P.No.1449 of 2025 dated 16.10.2025 on the file of the Principal Sessions Judge, Sessions Division of Ranipet District is confirmed and this Criminal Appeal stands dismissed.
