O R D E R

The petitioner was arrested and remanded to judicial custody on 29.09.2025, on execution of Non-Bailable Warrant issued by the learned Special Court for Essential Commodities Act Cases, Coimbatore for the

offence under Sections 8(c) r/w 20(b)(ii)(B) and 29(1) of NDPS Act, 1985, in respect of Crime No.24 of 2022 on the file of the respondent police, seeks bail.

2. It is the case of the prosecution is that the petitioner has been arrayed as an accused in Crime No.24 of 2022 under Sections 8(c) r/w 20(b)(ii)(B) and 29(1) of NDPS Act, 1985 and after filing charge sheet, the same was pending before the learned Special Court for Essential Commodities Act Cases, Coimbatore. Thereafter, the petitioner did not appear before the lower Court regularly. Hence, the lower Court has issued Non-Bailable Warrant against the petitioner on 13.06.2024. Thereafter, The petitioner was arrested and remanded to judicial custody on 29.09.2025.

3. The learned counsel appearing for the petitioner would submit that the non-appearance before the lower Court by the petitioner is neither wilful

nor wanton. However, he would also submit that the petitioner is ready to abide any condition as imposed by this Court and seeks for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the lower Court has issued Non-Bailable Warrant was ordered against the petitioner on 13.06.2024 and on execution of the NBW, he has been arrested and remanded to judicial custody on 29.09.2025. After the lapse of 15 months only the petitioner has been secured and remanded to judicial custody. The contraband involved in this case is 5 kgs of ganja. Hence, he vehemently opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the above facts and circumstances of the case and also considering fact, trial is not progressing due to non-cooperation of accused

and the quantity of contraband involved in this case, this Court is not inclined to grant bail to the petitioner.

7. Hence, this Criminal Original Petition stands dismissed. 31.10.2025 kmm To
