This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to act upon the representation made by the petitioner on 14.10.2025 wherein the petitioner is seeking cancellation of patta issued in the name of the second respondent.

2. Heard Mr.A.Balaji, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for first respondent.

The case of the petitioner is that the subject property was originally owned by her father-in-law and on his demise in the year 1971, it was inherited by petitioner's husband and other legal heirs. The petitioner's husband passed away in the year 1988 and the petitioner claims to be in peaceful possession and enjoyment of the property. The further case of the petitioner is that sub-division has been effected and several new survey numbers came into existence. According to petitioner, survey Nos.35/17A, 35/17B, 35/17C and 35/17D belong to the petitioner. A natham patta has also been issued by first respondent in favour of petitioner's two sons with respect to survey No.35/17B. For the remaining 3 survey numbers, patta has been issued in the names of 2/4

private persons, who according to petitioner, do not have any right or title over the property. Hence, the petitioner submitted a representation before the first respondent on 14.10.2025 to cancel the patta. Since the same was not acted upon, the present writ petition has been filed.

4. In the considered view of this Court, the petitioner is seeking cancellation of patta issued by first respondent. The petitioner has to necessarily file an appeal before the Revenue Divisional Officer under the Patta Pass Book Act. Liberty is granted to the petitioner to submit a fresh appeal/representation before the concerned Revenue Divisional Officer and on receipt of the same, the Revenue Divisional Officer shall deal with the appeal/representation on its own merits and in accordance with law after affording opportunity to the petitioner and all the other interested parties and pass final orders within a period of twelve (12) weeks from the date of receipt of the fresh representation/appeal from the petitioner.
