ORDER
This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 04.10.2025, seeking bail in Crime No.117 of 2025, registered for the offence punishable under Sections 115(2), 296(b), 351(2), 74 read with Section 4 of TNPHW Act and subsequently it was altered into Sections 115(2), 296(b), 309(4), 351(2), 74 read with Section 4 of TNPHW Act.
2. The allegation against the petitioner is that the defacto complainant's mother runs a tailoring business. On 30.09.2025, during night hours, while the defacto complainant's mother and one of this relatives were returning from their shift, the petitioner along with other accused waylaid them, abused them in filthy language and also assaulted them. Petitioner also robbed a sum of Rs.2,000/- and a laptop from their possession. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He has not committed any offence as alleged in the FIR. He further submitted that the petitioner is in custody from 04.10.2025 and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, the learned counsel prays for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that the respondent police recovered the stolen laptop from the accused and 10 cases are pending as against the petitioner and if he is released on bail, there is a possibility of abscondance and possibility of committing similar kind of offence. Hence he vehemently apposed for grant of bail to the petitioner.
5. Considering the submission made by the learned Government Advocate that the petitioner has 10 previous cases which are pending against him, and there is a possibility of indulging in similar kind of offence in future, I am not inclined to grant bail to the petitioner.
