ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.11.2025, for the alleged offence punishable under Sections 302 r/w. 201 of IPC in Crime No.397 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that, the petitioner was earlier arrested and released on bail for offences under section 302, & 201 of IPC. Thereafter, he has also appeared in the Sessions Court after committal in S.C.No.78 of 2022. On 25.07.2023, the petitioner was absent and the Non Bailable Warrant was issued against him. However, he was not secured and Non Bailable Warrant executed on 16.11.2024 and from that day, the petitioner is in custody. Hence, the complaint was registered.

3. The learned counsel for the petitioner submitted that, the petitioner is in custody for nearly one year and the trial is progressing. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) reported that the petitioner is in custody for nearly one year. However, the petitioner is also having 19 previous cases and that since he was not been properly produced before the Court due to his involvement in other cases, the trial has not been progressed.

5. This Court has called for report from the concerned Trial Court and report revealed that after securing the petitioner in the year 2024, only recently the proceedings were kicked on and the trial is fixed on 20.11.2025 and summons were also sent to the witnesses.

6. In view of the report submitted by the trial Court that the trial date is fixed, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition is dismissed. 18.11.2025 mpa To 1.Inspector of Police, Jolarpet Police Station, Chennai District.
