O R D E R

This Contempt Petition has been filed alleging willful disobedience of the orders of this Court, dated 07.06.2024 made in W.P.No.14700 of 2024. 2.This Court, by order dated 07.06.2024 in W.P.No.14700 of 2024, directed the respondents to consider the representations of the petitioner for survey of the property and demarcate the boundaries, after giving notice to the neighbouring land owners and any other interested persons. Now, it is the contention of the petitioner that the respondents have not conducted survey, despite the orders of this Court.

3.Whereas, the learned Special Government Pleader appearing for the respondents would submit that the petitioner's representation has been considered and as the petitioner's property could not be located within the boundaries as shown in the sale deed, survey could not be done and orders have been passed to that effect on 12.12.2025 vide Proceedings in

Na.Ka.3687/2025/P5.

4.However, the learned counsel for the petitioner vehemently would submit that the survey has not been conducted and proper notice has not been issued and hence, contempt is still maintainable. 5.As the order which is the subject matter of this contempt, has already been complied with, merely because the petitioner is not satisfied with the order passed by the respondents, it cannot be said that contempt is still maintainable. If at all the petitioner wants to establish his right, the remedy is always open to him to file an appropriate suit based on his title and establish his case before the concerned Civil Court. It is also made clear that any order passed by the Revenue authorities will not be taken as an evidence in respect of title and other aspects. The same has to be independently established before the Civil Court. 6.Since the orders of this Court have been complied with, as stated above, this Contempt Petition is closed.
