ORDER
This petition has been filed to relax the condition viz., ''....the petitioner shall appear before the trial court once in three months, on the first working day of the concerned English Calender month at 10.30 a.m. commencing from July 2019, until further orders...'' imposed on the petitioner vide order dated 27.04.2019 in Crl.M.P.No.5953 of 2019 in Crl.A.No.601 of 2018.
2. Earlier, the petitioner, on conviction, filed suspension of sentence petition in Crl MP No.13231 of 2018. This Court, vide order dated 01.11.2028, suspended the sentence on condition that the petitioner shall report before the trial Court on the first working day of every English Calendar month at 10.30 a.m., until further orders. Thereafter, the petitioner filed a relaxation petition in Crl.MP No.5953 of 2019 and this Court, by order dated 27.04.2019, on
considering the petitioner's health condition, directed him to appear once in three months.
3. Now the present petition is filed along with medical records confirming that the petitioner is a dialysis patient and he has been dialyzed weekly thrice and due to dialysis, he gets weak and it is difficult for him to comply with the condition. Hence, he filed this petition for modification. 4.It is seen that the petitioner is residing with his family and he is permanent resident and he gave undertaking that he would pursue the appeal. 5.The learned counsel for the petitioner submitted that the petitioner is a senior citizen, aged about 69 years and he is a dialysis patient and facing difficulty in complying with the condition due to his ill health and old age. Hence, prays to relax the condition.
6.The learned Additional Public Prosecutor appearing for the respondent
police submitted that the petitioner is complying with the conditions diligently. 7.Considering the fact that petitioner is a dialysis patient and the submission made by the learned Additional Public Prosecutor that the petitioner has been complying with the condition diligently, the condition imposed on the petitioner to appear before the trial court once in three months, on the first working day of the concerned English Calender month at 10.30 a.m. commencing from July 2019, until further orders, is totally relaxed while all other conditions remain unaltered.
