PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a writ of Mandamus, directing the 1st respondent / District collector to consider the petitioners representation dated 30.06.2025 to forthwith initiate departmental disciplinary action against the 5th respondent/ Deputy Tahsildar Panruti and the 6th Respondent / Village Administrative officer, Perumal Naickenpalayam for their gross misconduct, corruption abatement, failure to discharge statutory duties, as established by their issuance of bogus certificates and fraudulent revenue records, particularly in light of the official findings of the District Registrar dated 2.09.2025.

ORDER

This petition has been filed seeking a direction to the 1st respondent / District collector to consider the petitioners representation dated 30.06.2025 to forthwith initiate departmental disciplinary action against the 5th respondent/ Deputy Tahsildar, Panruti and the 6th Respondent / Village Administrative officer, Perumal Naickenpalayam for their gross misconduct, corruption abatement, failure to discharge statutory duties, as established by their issuance of bogus certificates and fraudulent revenue records, particularly in light of the official findings of the District Registrar dated 2.09.2025.

2. The fraud involved the VAO issuing a false certificate dated 03.04.2025 concerning a cancelled patta on 13.03.2025, which was used by the

Sub-Registrar to register the fraudulent document No.1427/2025 dated 07.04.2025. This illegal act is official confirmed by the District Registrar dated 02.09.2025. Therefore, the petitioner made a representation to the District Collector/first respondent on 30.06.2025 to forthwith initiate departmental disciplinary action against the 5th and 6th respondents for their misconduct and corruption abetment, failure to discharge statutory duties. The same is kept pending without any process. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the first respondent to consider the petitioner's representation and pass appropriate orders within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader submitted that there is a property dispute between the petitioner and the private respondents, which cannot be solved before this Court under 226 of Constitution of India.

5. Heard the learned counsel for the petitioner as well as the learned Standing Counsel appearing for the respondents and perused the materials available on record.

6. This Court perused the entire records. On perusal of the same, it is made clear that the claim made by the petitioner is disputed question of fact, which

cannot be decided by this Court under Article 226 of the Constitution of India and there is an effective remedy available before the Civil Court. The petitioner has to approach the Civil Court. Without doing so, filing the present petition is not sustainable.

7. In the result, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is also closed.
