O R D E R
The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120 (B), 420 of IPC and Section 5 of TNPID Act, and Section 3, 5 of BUDS Act in Crime No.3 of 2025 on the file of the respondent police, seek anticipatory bail. 1/4

The case of the prosecution is that the petitioner is the friend of the defacto complainant and alleged to have induced the defacto complainant to invest around Rs.63,52,526/- and as against the deposit amount, she had received Rs.26,63,897/- as profit from the accused and yet to repay Rs.36,88,629 along with interest. Hence the case.

The learned counsel for the petitioner would submit that the petitioner had not committed in any offence as alleged and she has been falsely implicated in this case and she is in judicial custody from 08.10.2025 and she is ready to abide any condition imposed by this Court and hence, prayed to enlarge the petitioner on bail.
4. The learned Government Advocate (Crl.side) would submit that totally there are nine accused in this case and the petitioner is arrayed as A8. Though it is stated that the petitioner/A8 was also actively involved business activities and the petitioner has alone separately collected Rs.3.64 crores and investigation in this case is pending and further A1 to A4 & A9 are still absconding. Hence, he opposed to grant bail to the petitioner. 2/4

Considering the facts and circumstances of the case and having perused the records, reveals that totally 8.86 crores were collected from 46 depositors under the various schemes and subsequently, they repaid only 1.17 crores and balance amount of Rs.7.50 crores yet to be recovered and there is no recovery from the petitioner, this Court is not inclined to grant bail to the petitioner.
