PRAYER: This Petition has been filed under Article 227 of Constitution of India, to allow the CRP and directing District Munsif, Paramathi to enquire the execution petition in REP No. 13 of 2021 and pass final orders expeditiously and thus render justice.

ORDER
The revision petitioner seeks limited relief to expedite the enquiry in REP No.13 of 2021 on the file of learned District Munsif, Paramathi.
2. In view of the limited relief sought by the petitioner, notice to the respondents is dispensed with.
3. The grievance of the petitioner is that despite the suit being filed in the year 2010 and the execution petition also filed four years back, the Judgment debtors are protracting the proceedings and denying the decree holder, the fruits of the decree. The Hon'ble Supreme Court in a recent decision in the case of Periyammal (Dead) through Lrs. & others vs. V.Rajamani & another etc., decided on 06.03.2025, reported in 2025 INSC 329, reiterating the decision rendered in Rahul S.Shah vs. Jinendra Kumar Gandhi reported in (2021) 6 SCC 418 and Bhoj Raj Garg vs. Goyal Education and Welfare Society & others, Special Leave Petition (C)
Nos.19654 of 2022 has held that the execution petitions pending in various Courts shall be decided and disposed of, within a period of six (6) months from the date of filing of execution petition.

In the light of the above and following the aforesaid decisions of the Hon'ble Supreme Court, and also considering that the parties have let in evidence, this Court directs the learned District Munsif, Paramathi, to dispose of REP No.13 of 2021, pending on its file, on merits and in accordance with law, after considering all the Interlocutory Applications, if any, pending and dispose of the same by 31.01.2026.
5. With the above directions, this Civil Revision Petition is disposed of. No costs.
