ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.09.2025, for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii)(B), 29(1) of NDPS Act in Crime No.336 of 2025, on the file of the 1/4

respondent police, seeks bail.

2. The allegation against this petitioner is that this petitioner is ranked as A6, and on his instructions A2 to A4 to collect ganja from Andhra Pradesh to supply and sell the same and in this case they brought ganja and portion of the ganja was handed over to A1. On information, the police have arrested A1 with possession of 1.450 kgs of ganja which is intermediate quantity on the basis of confession given by A1, this petitioner was included as an accused and he was earlier in prison in connection with Crime No.329 of 2018 on the file of Ice House Police Station and he was arrested by executing PT warrant on 16.09.2025. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 17.09.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that though there is no recovery effected from this petitioner herein, based on the statement recorded from A1 this petitioner included as an accused and the petitioner is the habitual offender and sell the ganja with the help of other accused. He further submitted that this petitioner having 34 previous 2/4

cases apart from this case out of which few cases are NDPS case, if the petitioner released on bail he will indulge in similar offence, and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions of the learned counsel on either side, the previous cases of the petitioner reveals that he is having nearly 34 previous cases, out of which few cases are NDPS case, if the petitioner released on bail he will indulge in similar offence, and this Court is not inclined to grant bail to the petitioner.
