O R D E R

The petitioners, who were arrested and remanded to judicial custody on 10.09.2025 for the alleged offence under Sections 408, 420, 120(B), 466, 468, 471, 477A of IPC in Crime No.3 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the first petitioner, while she was working as an Assistant Manager in the Villupuram Central District 1/6

Co-operative Bank, Gingee Branch, during the period from 22.08.2017 to 16.04.2019, has transferred a huge amount to the tune of Rs.16,90,41,206.85/- to the account of the second petitioner with the help of the other accused persons in the case, without any valid documents. Hence this case.

3. The learned counsel for the petitioners would submit that the petitioners had not committed in any offence as alleged and they have been falsely implicated in this case. He would further submit that already their property was attached by the defacto complainant and only Rs.2.2 crores is yet to be recovered and that the petitioners are ready to co-operate for the recovery of the balance amount. The petitioners have been suffering incarceration from 10.09.2025 and he prayed to enlarge the petitioners on bail.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that totally there are nine accused involved in this case. The petitioners herein have been arrayed as A1 & A2. He would further submit that u/s 81 of T.N.C.S. Act, 1983 enquiry was ordered and the petitioners have repaid Rs.14.64 Crores and remaining Rs.2.2 crores is yet to be recovered. Hence, 2/6

he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record.

Considering the facts and circumstances of the case, the period of incarceration and also of the fact that out of the misappropriated amount, Rs.14.64 Crores have been recovered and the property of the petitioners have also been attached, I am inclined to grant bail to the petitioners with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate Court, Gingee and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioners shall report before the respondent police at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation.

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 31.10.2025 kmm Note :
