Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider the representation of petitioner dated 18.09.2025 and to count his service from 07.09.1998 to 01.09.2005 for the purpose of pension eligibility, and consequently to bring the petitioner under the Tamil Nadu Pension Rules, 1978 (Old Pension Scheme), instead of the Contributory Pension Scheme introduced vide G.O.Ms.No.259, Finance (Pension) Department, dated 06.08.2003 and to direct the respondent to transfer the petitioner's 1/4

pension contributions already collected under the CPS to the Old Pension Scheme account and to grant him all consequential retiral benefits including pension, gratuity, leave encashment and other terminal dues by duly reckoning his continuous service from 07.09.1998 onwards. O R D E R

This writ petition has been filed for a direction directing the respondent to consider the representation of petitioner dated 18.09.2025 and to count his service from 07.09.1998 to 01.09.2005 for the purpose of pension eligibility, and consequently to bring the petitioner under the Tamil Nadu Pension Rules, 1978 (Old Pension Scheme), instead of the Contributory Pension Scheme introduced vide G.O.Ms.No.259, Finance (Pension) Department, dated 06.08.2003 and to direct the respondent to transfer the petitioner's pension contributions already collected under the CPS to the Old Pension Scheme account and to grant him all consequential retiral benefits including pension, gratuity, leave encashment and other terminal dues by duly reckoning his continuous 2/4

Without expressing any opinion on merits of the writ petition, the second respondent is directed to consider the representation of the petitioner dated 18.09.2025 and, after issuance of notice to the petitioner and giving him personal opportunity of hearing, to pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order.

With the above direction, this writ petition is disposed of. There will be no order as to costs.
