ORDER

This writ petition has been filed directing the respondent to pay difference in gratuity based on 13th Wage Settlement dated 04.01.2018 and also to refund Rs.80,000/- which was recovered from petitioner's gratuity with applicable interest. 1/4

2. The petitioner had joined in the service of the respondent Corporation as Conductor. Thereafter, he was upgraded to Special Grade Conductor and retired from service due to attainment of superannuation as on 30.11.2017. The 13th Wage Settlement was arrived on 04.01.2018 and it was given effect from 01.09.2016. Accordingly settlement wage was revised and pension was also revised. However, the petitioner was not granted any difference in gratuity based on the 13th Wage Settlement.

3. In view of the above, the respondent is directed to disburse the difference in gratuity as per the 13 Wage Settlement with interest at the rate of 6 % per annum, within a period of 8 weeks from the date of receipt of a copy of this court.

4. Insofar as the refund of Rs.80,000/- is concerned, the petitioner ought to have challenged the recovery in the manner known to law, if so advised.

5. With the above directions, the writ petition stands disposed of. No costs. 11.11.2025 Speaking (or) Non Speaking Order mrn 2/4
