O R D E R

The present Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 to 4 to take necessary action against the 5th respondent for a non-registration of the FIR based on the petitioner's representation dated 26.06.2025.

Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and perused the materials available on record.

The case of the petitioner is that on 29.06.2022, while she was walking, a two wheeler bearing registration No.TN 11 AT 3283 dashed against her, due to which, she sustained grievous injuries. She was admitted to the Government hospital, where she was treated and thereafter, she continued treatment as an outpatient in a private hospital. The petitioner's daughter lodged a complaint before the 5th respondent (Traffic Police). However, the 5th respondent has not registered any case. Thereafter, the 2/6

petitioner had sent a representation to the respondents 1 to 4 to take action against the 5th respondent for inaction on his part. Since no action was taken against the 5th respondent, the present writ petition has been filed. 4.

The learned counsel appearing for the petitioner submitted that since the 5th respondent had not registered the case and conducted the investigation, the petitioner was unable to file an M.C.O.P. 5.

The learned Additional Public Prosecutor submitted that based on the complaint given by the petitioner's daughter regarding the accident that occurred on 29.06.2022, a case in Crime No.865 of 2022 was registered as early as on 03.11.2022 and the investigation is pending. The 5th respondent had duly acted upon the complaint of the petitioner's daughter and hence, there is no lapse on his part. In such view of the matter, the present Writ Petition is not maintainable.

Taking into consideration the fact that the 5th respondent has registered a case in Crime No.865 of 2022, there appears to be no inaction on the part of the 5th respondent. However, the 5th respondent is directed to complete the investigation and file a final report along with an application seeking condonation of delay and obtain the insurance and licence 3/6

particulars and hand them over to the petitioner within a period of four weeks from the date of receipt of a copy of this order, to enable the petitioner's daughter to file an MCOP.

With the above direction, this Writ Petition (Criminal) stands disposed of.
