2. S.Vasanth S/o.Senthilkumar (R2 set ex-parte before the Tribunal) ... Respondents / Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.D.Bhaskaran learned counsel for the Appellant/Insurance Company and Mrs.Ramya V.Rao learned counsel for the 1st respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.8,09,500/- [Rupees Eight Lakhs Nine Thousand and Five Hundred Only], together with interest at 7.5% per annum, from the date of petition till the date of deposit. Aggrieved by the award of the Tribunal, the appellant/Insurance Company preferred the present appeal.

2. After due deliberation and consultation, both the parties have agreed to modify the award to a sum of Rs.5,40,000/- (Rupees Five Lakhs Forty Thousand Only). The above said modified amount shall carry interest at the rate of 7.5% per annum from the date of claim petition till the date of deposit with proportionate cost.

3. Hence, the Appellant/ insurance company is directed to deposit the modified amount of Rs.5,40,000/- (Rupees Five Lakhs Forty Thousand Only), arrived today, less the amount already deposited if any, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.C.O.P.No.1577 of 2023 on the file of the Motor Accident Claims Tribunal (Special District Court No.I) Cuddalore and on such deposit, the 1st respondent/claimant is directed to withdraw the same.

4. The Tribunal is directed to transfer the amount through RTGS/NEFT to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.

5. The Civil Miscellaneous Appeal is disposed of accordingly. No costs. Consequently, connected civil miscellaneous petition is closed, if any.
