O R D E R
The petitioner who was apprehending arrest at the hands of the respondent police for the offences punishable under Sections 415, 420 of IPC, in Crime No.259 of 2022, seeks anticipatory bail. 2.
The allegation against the petitioner is that the petitioner 1/7
joining hands with other accused had collected a sum of Rs.26,50,000/- from the defacto complainant under the pretext of floating various schemes and subsequently cheated him. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is ranked as A5 and already A1 to A4 were arrested and released on bail and the petitioner has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the specific overt act is that the petitioner along with other accused/A4 had collected a sum of Rs.1,50,000/- from the defacto complainant. Hence, he opposed for grant of anticipatory bail to the petitioner.
5. Heard the learned counsels on either side and perused the materials available on record.
6. Considering the nature of allegations and the fact that the petitioner had received a sum of Rs.1,50,000/-, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
7. Accordingly, the petitioner is directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Crime No.259 2/7
of 2022 and on such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of ten days from the date of receipt of a copy of this order, before the learned V Metropolitan Magistrate, Egmore on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further condition that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation;
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on 3/7
bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
