ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 43, 66 of IT Act, and 318(4), 336 and 340 (2) of BNS in Crime No.16 of 2025, on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner joined hands with 17 other persons, floated various types of online schemes, inviting investments from various persons. The total amount involved in this case around 42 crores, and the total number of persons cheated is 700. Hence the case.

The learned counsel for the petitioner submitted that in this case some of the co-accused were granted anticipatory bail by the Sessions Court, on the ground that custodial interrogation in the case of this nature is not necessary. He further submitted that as per the allegation against the petitioner, he only assisted the other accused and did not benefit from the transactions. Hence, Prays for grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) submitted that though the initial allegations are levelled by the defacto complainant for a small amount of Rs.4, 50,000/-, subsequent complaints were poured in and the investigation revealed that a large network of persons involved in collecting money in the name 2/4
of investments under the various schemes, with the intention to cheat the public. He further submitted that the petitioner alone has separately floated a "go free cycle scheme" wherein if a person invested in 25 cycles for Rs.2,25,000/- they will get Rs.22,000/- per month, and it goes up to the maximum level of 1000 cycles worth Rs.90 lakhs and return of Rs.12 lakhs per month. Apart from that, this petitioner alone individually collected a sum of Rs.3.1 crores. He further submitted that investigation in this case is pending. Hence, opposed for grant of bail to the petitioner.

I have considered the submission made on both sides and perused the records, it reveals that the case involves complicated investigation, with a large groups of persons operating on an online platform, collected huge amounts. Though it was started with the purchase of cryptocurrency, it multiplied into various schemes. Considering the fact the total amount involved so for is Rs.42 crores and the investigation is pending, and granting anticipatory bail to the petitioner would hamper the investigation. Hence, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
