ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 296(b), 132, 351(2), 303(2) of BNS r/w 21(1) of MM Act in Crime No.404 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against this petitioner is that the petitioner was illegally quarried and was transporting the sand by using JCB and Tractor without valid permission. Hence, the case.

rna has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner is arrayed as A3, no previous case is pending against the petitioner, this petitioner transported the sand without permission. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the petitioner involved illegally quarried the sand by earthmover (JCB) also by using lorry and caused damage to ecology and waterbody, if the petitioner is granted bail he would in similar offences, hence this Court is not inclined to grant anticipatory bail to the petitioner.
