ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This public interest litigation is misconceived. The dispute

involved in this petition appears to be civil in nature, regarding occupation and encroachment on the passage used by the residents, including the petitioner. This is essentially a matter which can be raised before the civil court and not in the writ court.

3. The petition is dismissed. There shall be no order as to costs.
