ORDER
The petitioners are the applicants in O.A.No.126 of 2025 before the National Green Tribunal (South Zone). The relief sought for in O.A.No.126 of 2025 is to remove the compound wall. No final orders have been passed in the said Original Application. Pending the O.A., the impugned order has been
passed by the Tamil Nadu State Coastal Zone Management Authority rendering O.A.No.126 of 2025 infructuous.
2.When a judicial authority is seized of a proceeding, a respondent before the said authority cannot pass an order making the very proceeding infructuous. Taking note of this fact, and also that the compound wall was pre-existing even before the Coastal Zone Management Authority was contemplated by law, I granted interim stay of those proceedings alone. I made it clear in paragraph No.7 of the interim order that the order of stay will not prevent the National Green Tribunal in any manner for proceeding further with O.A.No.126 of 2025. The applicants would have to work out their right independently in the said O.A. They have no right to interfere with this proceeding as they are not the owners of the property. Hence, the Writ Miscellaneous Petition stands dismissed.
