Order (Order of the Court was made by R.Suresh Kumar J.) Prayer sought for in this writ petition is for a Writ of Mandamus directing the 1st respondent to pass orders on the statutory appeal filed by the petitioner dated 12.09.2025 against the order passed by the 2nd respondent in Order No. 386/ 2023 dated 19/08/2025 within a limited time frame.
2. The petitioner was working as a Senior Bailiff, against whom disciplinary proceedings were initiated, which culminated in a punishment of removal from service dated 19.08.2025 passed by the second respondent.
3. As against the said order of punishment, since there has been a statutory appeal available before the first respondent, such an appeal has been filed by the petitioner on 12.09.2025 and the same since has not been disposed of so far, in order to dispose the said appeal on merits, the present writ petition has been filed seeking a writ of Mandamus to be issued to the first respondent ie., the appellate authority.
4. Heard Mr.K.Venkataramani, learned Senior Counsel for the petitioner and Mr.Kaithamalai Kumaran learned counsel for the respondents.
5. Learned counsel on instructions would submit that, the appeal dated 12.09.2025 was received at the office of the appellate authority on 14.10.2025. On perusal of the appeal, the appellate authority has directed the disciplinary authority to forward the records with English translation within a period of four months and such a communication has been sent on 16.10.2025 by the appellate authority to the disciplinary authority. The four months period is yet to be over. Therefore, once the records are received with translated copy, the appeal will be considered and proceeded in a routine manner.
6. We have considered the submissions made by the learned counsel for the respondents. Since the appeal has been pending admittedly from 14.10.2025, and three months period is almost going to be completed, we feel that let the records as has been sought for by the communication dated 16.10.2025 be received by the appellate authority by sending another reminder to the disciplinary authority within a period of one month from the date of receipt of a copy of this order. On receipt of such records, the appeal filed by the petitioner, after being considered on merits, be disposed of within a period of two months thereafter.
