ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.09.2025, for the alleged offence punishable under Section 408 of IPC in Crime No.89 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that while managing the shop of the de facto complainant, the petitioner misappropriated a sum of Rs.78,19,575/- between January 2018 and December 2022.

3. The learned counsel for the petitioner submitted that the petitioner had already paid a sum of Rs.1,10,000/- and had not misappropriated extent of money as stated. All payments were made to the suppliers' accounts, and the de facto complainant had not properly accounted for these payments. The de facto complainant's son is now looking after the business and is ready to abide by any condition imposed by this court. He further submitted that the petitioner has been in incarceration since 09.09.2025 and further incarceration is not necessary. Hence, he prayed to grant bail to the petitioner.

4. The Government Advocate (Crl.Side) appearing for the respondent police reported that the total money misappropriated by the petitioner through

falsification of accounts and fabrication of records is Rs.78,19,575/- and the coaccused A2 is still absconding, and so far, no money has been recovered. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioner has been arrested and so far no money has been recovered and A2 is still absconding, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this criminal original petition is dismissed.
