ORDER

This petition has been filed by the petitioner seeking for a direction to withdraw the Look Out Circular issued against him in Crime No.254 of 2023 on the file of the 3 rd respondent.

2. Mr.N.L.Rajah, learned Senior Advocate appearing for the petitioner submitted that the petitioner is a citizen of the USA and he is a person of Indian origin. The petitioner had invested in a company named M/s.Sri Kamatchi Renewable Energy Pvt. Ltd. at Porur and he was originally residing at the USA and without the knowledge of the petitioner, the persons who were running the factory had stored 15 litres of methanol in a 30 litre container. The petitioner, after coming to know about the same, 2/6

had intimated the authorities. However, based on the complaint given by one Thangapandian, Village Administrative Officer of Porur, a case in Crime No.254 of 2023 was registered by the respondent police. The respondent police had issued a Look Out Circular as against the petitioner and when he had come to India on 14.12.2024, he was arrested and handed over to the 3 rd respondent. As the petitioner co-operated for enquiry, he was subsequently granted bail on 27.12.2024 and thereafter, conditions were also relaxed on 17.03.2025. However, when the petitioner had attempted to go back to the USA, he was stopped at the Airport on account of pendency of the Look Out Circular.

He would further submit that the Look Out Circular was issued only to ensure that the petitioner was cooperating for the investigation or interrogation and once the purpose is solved, there is no necessity to keep the Look Out Circular pending. He would also submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and also undertakes to participate in the Court proceedings.

3. The learned Government Advocate (Crl. Side) submitted that the petitioner is an accused in Crime No.254 of 2023 and the investigation in this case has been completed and final report has also been filed. He further submitted that since the petitioner is an American national, there is a possibility of him absconding and that is the reason the Look Out Circular is kept pending against him.

In view of the above, the petitioner is directed to appear before the Judicial Magistrate, Poonamallee, and execute a bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties and also file an affidavit of undertaking that he will appear before the trial Court for facing trial proceedings. The petitioner shall also furnish his e-mail ID to the Court below to enable the Court to serve summons through electronic mode. The petitioner shall also furnish his permanent address in the U.S.A. On such conditions being complied with, the first respondent within a period of one week thereafter shall issue directions to keep the Look Out Circular in 4/6

abeyance and communicate the same to the Immigration Authorities so as to enable him to travel from and to India. In the event of the petitioner not cooperating for facing trial, the respondents are at liberty to revive the Look Out Circular and secure him and produce before the trial Court to face trial.

5. With the above observations and directions, this Criminal Original Petition is disposed of.
