2.When the matter was taken up today for hearing, the learned Govt. Advocate (Crl.Side) submitted that the investigation has been completed and after a thorough enquiry, the respondent police have closed the case as undetected. However, it is also submitted that in the event of any further information with regard to the accused, the respondents will obtain necessary orders from the Court concerned and proceed with further investigation.
3.At this juncture, the learned counsel for the petitioner submitted that the petitioner has got certain valid clues and information with regard to the accused, but the respondents are not reopening the case. Hence he seeks a direction to the Learned Judicial Magistrate, Kunnam to hear the petitioner and pass appropriate orders for further investigation if the Magistrate is convinced.
4.Taking into consideration the submissions made, the petitioner is 3/6
directed to approach the Learned Judicial Magistrate, Kunnam and file an application seeking further investigation. After enquiring the petitioner, if the learned Judicial Magistrate is convinced, appropriate orders for further investigation shall be passed.
