ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed under Article 226 of the Constitution of India seeking a direction to respondents 1 to 6 to remove the encroachment and blockage made by respondents 7 to 9 in the 10 feet wide panchayat cement road in Survey No.45/11A of B.S.Thimmasandiram Village, Berigai Post, Shoolagiri Taluk,

2. Learned Additional Government Pleader has filed the status report submitting that the aforesaid land to an extent of 0.02.00 hectare stands registered in the name of Kathiri Khan as per patta

No.19 in UDR 'A' Register. The aforesaid land was being used by the general public to reach their house and agricultural land. Now, the land owners have all of a sudden tried to close the path contending that the said path is passing through their patta lands. This, being an easementary right, has to be established in proper proceedings before the civil Court.

3. In view of the aforesaid status report, we are not inclined to entertain this writ petition. Accordingly, the same is dismissed. However, petitioner would be at liberty to seek redressal of grievance in accordance with law, if so advised. There shall be no order as to costs.
