ORDER
This petition has been filed to modify the condition Nos.10(b), 10(e) that, 10(b). The Petitioner has to mobiles a sum of Rs.100 crores on his own and the same shall be deposited before the TNPID Court to the credit of
C.C.NO.1 of 205 on or before 30.10.2025.
10(e). On expiry of the temporary bail period i.e., 30.10.2025, the petitioner shall voluntarily surrender before the Special Judge for TNPID Act Cases, Chennai on 31.10.2025, on such surrender, the petitioner to be committed to the prison, imposed on the petitioner in Crl.O.P.No.18872 of 2025 by its order dated 15.09.2025.

The petitioner, who is the second accused in Crime No.14 of 2024, has sought modification of the conditions imposed by this Court while granting interim bail in Crl.O.P.No.18872 of 2025, dated 15.09.2025. According to the petitioner, he was enlarged on interim bail for a period of 45 days with certain conditions, including mobilizing and depositing a sum of Rs.100 crores before the TNPID Court on or before 30.10.2025, pursuant to the order passed in Crl.O.P.No.18872 of 2025.
3. The learned counsel for the petitioner submitted that he had already furnished details of 76 immovable properties, which are now under the custody
of this Court for liquidation and repayment to the depositors, in order to comply with the directions issued. He further submitted that, despite earnest efforts to mobilize Rs.100 crores by availing loans, the petitioner could not succeed. He also made sincere attempts to identify prospective purchasers to dispose of the assets. However, due to national holidays and festival periods, he was unable to mobilize the required funds. He continues to make efforts, therefore, the petitioner prays for modification of conditions 10(b) and 10(e) with regard to mobilizing Rs.100 crores on or before 31.10.2025. The learned counsel for the petitioner further submitted that the petitioner is a senior citizen suffering from various medical ailments and is still under continuous treatment. Even as per the final report, the alleged amount comes to around Rs.36 crores. Hence, he seeks modification of the conditions imposed by this Court.

On the other hand, the learned counsel for the intervenors raised objections, stating that for the purpose of obtaining interim bail, the petitioner had filed an undertaking affidavit before this Court stating that he would abide by any condition imposed. Considering his undertaking as well as the
submissions made through his counsel, this Court granted 45 days' time to mobilize Rs.100 crores to demonstrate his bona fides. However, thereafter he failed to mobilize any amount as assured. Most of the victims are senior citizens, and their hard-earned money has been affected due to the acts of the petitioner and other accused. Therefore, they strongly oppose any modification of the conditions.
5. The learned Government Advocate (Crl.Side) also raised objections, stating that the condition to deposit Rs.100 crores was imposed based on the undertaking affidavit filed by the petitioner. Since he failed to comply with the said condition, the prosecution prayed for dismissal of the petition as being devoid of merits.

Upon perusal of the records, it is seen that challenging the conditions imposed by this Court in Crl.O.P.No.18872 of 2025, the petitioner preferred SLP(Crl.)No.16636 of 2025, wherein the Hon'ble Apex Court observed that not inclined to interfere with the impugned order of this Court but granted liberty
only to seek extension of time.
7. Therefore, as on date, the conditions imposed by this Court while granting interim bail stand confirmed by the Hon'ble Apex Court, and the liberty granted was only for seeking extension of time.
8. On perusal of the prayer in the present petition, it is clear that the petitioner seeks modification of conditions and not extension of time. As the order passed by this Court has already been confirmed by the Hon'ble Apex Court, modification of the conditions imposed by this Court is not sustainable, as rightly pointed out by the learned Prosecutor as well as the counsel for the intervenors.
9. As on date, the conditional order imposed by this Court in Crl.O.P.No.18872 of 2025, dated 15.09.2025 remains uncomplied.
10. Therefore, the interim bail granted by this Court on 15.09.2025 stands vacated. Accordingly, Crl.O.P.No.18872 of 2025 is dismissed. The respondent police is directed to secure the accused in the manner known to the law.
