Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the order dated 18.08.2017 issued by the third respondent and the order No.CPPC dated 15.06.2017 issued by the fourth respondent, quash the same and consequently direct the respondents to fix the pay of the petitioner as per Circular No.179 dated 12.05.2015 and Circular No.200 dated 12.04.2018 issued by the first respondent and pay the Dearness Relief on Pension to the petitioner with effect from 31.12.2015 with interest @ 9% till the actual date of payment and other consequential service benefits. This writ petition has been filed challenging the order dated 18.08.2017 passed by the third respondent and the order dated 15.06.2017 passed by the fourth respondent.
2. On perusal of records, it is revealed that the impugned orders have been passed in the year 2017. Now, it is challenged after a period of 8 years, there is absolutely no explanation on the part of the petitioner. That 2/5
apart, subsequent to the order impugned in this writ petition, the petitioner submitted a representation and it was not considered. Therefore, the petitioner and others approached this Court in W.P.No.28406 of 2023 and this Court directed to consider the representation and pass appropriate orders in accordance with law.
3. However, it was not complied with and as such, the petitioner and others filed a Contempt Petition in Cont.P.No.5674 of 2024 and the same was dismissed on 25.10.2024 for the reason that the communication dated 31.08.2024 would amount to consideration of the petitioner's representation. As such, there was no disobedience on the part of the respondents. However, once again,the petitioner is challenging the very same impugned order and also challenging subsequent order. Therefore, the order impugned in this Writ Petition was confirmed by the respondents by communication dated 31.08.2025.
4. In view of the above, this Court finds no infirmity or illegality in the orders passed by the third and fourth respondents. Accordingly, this 3/5
Writ Petition is dismissed. Consequently, the connected Miscellaneous Petitions are closed. No costs.
