PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus,directing the 5 th respondent or his agents, men, not to take any coercive steps or public auction of the land bearing S.No.137/1 at about 0.52.50 Ars which means 0.65 cents, situate at Thittakudi, Cuddalore District until the disposal of the appeal dated 25.08.2025 pending before the 1 st respondent.

ORDER

Mr. P. Muthamizhselvakumar. learned counsel appearing for the petitioner fairly submitted that the respondents already disposed of the petition. However, the appeal filed by the petitioner is pending with the 1 st respondent from 25.08.2025 and without disposal of the appeal, if the respondents bring the property for auction, the petitioner would be seriously jeopardised, necessitating the filing of the present Writ Petition.

2.Mr.K. Karthekeiyan, learned Government Advocate appearing for the respondents submitted that as on date, no steps have been taken for conducting public auction and a direction may be issued to dispose of the application, as expeditiously as possible.

3.Considering the above, the 1 st respondent is directed to hear the appeal and dispose of the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. Till such time, the petitioner's property shall not be brought to public auction. Accordingly, this Writ Petition is disposed of.
