This application has been filed by the applicant to condone the delay of 127 days in filing the written statement in C.S.No.78 of 2025.

2. According to the applicant, he is the first defendant in the main suit. Since there occurred a sudden death in the family of the defendants, he was unable to file the written statement within the prescribed time limit.

3. The other side has not seriously objected.

4. Considering the above-said reasons stated in the affidavit, the facts and the circumstances of the case, and in order to give a fair chance to the applicant to defend the case, this application is allowed.
