ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 6(4) Tamil Nadu Scheduled Commodities (RDCS) order, 1982 and 7(1)(a)(ii), Essential Commodities Act, 1955 in Crime No.317 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 26.10.2025 when the police were on patrol duty, the accused had illegally transporting 70 bags containing 2800 kgs of RCDS Rice in TATA 207 vehicle without valid licenses. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution's case and submitted that one previous case is pending against the petitioner, who is arrayed as A2. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the huge quantity is recovered and one previous case is pending against the petitioner, investigation is pending and if the petitioner is granted anticipatory bail, he will indulge in similar offences, hence this Court is not inclined to grant anticipatory bail to the petitioner.
