ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 296(b), 115(2), 324(4)(5), 85, 108 of BNS r/w Section 4of TNPHW Act in Crime No.34 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against this petitioner is that this petitioner is ranked as A4 and he joined with A1, who is the husband of the deceased in this case and they involved in harassment of the deceased and on the date of occurrence, the petitioner and other accused allegedly forced open the door at the deceased's mother's house and attacked her. rna threaten the victim, damaged property, and verbally abused her, claiming to possess LEWD videos of her. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner is arrayed as A4, based on the dying declaration case was registered and the investigation is pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the arrested accused are still in custody, the investigation is still pending, if the petitioner is granted anticipatory bail, there is possibility of tampering the witnesses and hampering the investigation, and this Court is not inclined to grant anticipatory bail to the petitioner.
