ORDER

The petitioner apprehends arrest for the alleged offence under Section 191(1), 191(2), 118(2), 109, 103(1), 190 of BNS Act, 2023, in Crime No.195 of

2025 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that on 10.08.2025 at about 12.15 a.m., while the defacto complainant and the deceased were dancing inside OMG Pub along with their friends, a quarrel broke out between the defacto complainant's group and the Pub's managing staff including bouncers. During the altercation, the deceased Moshik and his friends and certain bouncers attacked them-specifically the petitioner struck Sajan on the head with a pizza pan causing severe injuries, while two others Ashol and Raj, stabbed the victims with knife and others assaulted them using pizza bats and pasta plates. As a result of grievous injuries, the deceased died, whereas Sajan was later discharged after treatment. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner, who is the Manager of the OMG pub, attempted to pacify the issue and he has not attacked any persons and that the petitioner is ready to co-operate for the investigation. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor, Puducherry submitted that there are totally ten accused in this case and the petitioner is arrayed as A8. This

petitioner has also attacked the injured as well as the deceased by using various weapon and he further submitted that the investigation is not yet concluded. 5.Considering the fact that the petitioner is also involved in attacking the injured as well as the deceased and the gravity of offence, I am not inclined to grant anticipatory bail in this regard.

6.Accordingly, this Criminal Original Petition is dismissed. 31-10-2025 gbi
