Mr.S.Balaji, learned Government Advocate (Crl. Side) takes notice on behalf of the first respondent. Mr.K.S.Jeya Ganesh, learned counsel takes notice on behalf of the respondents 2 and 3. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent to consider the representation dated 30.09.2025 issued by the petitioner, conduct an enquiry and cancel the Petroleum License P/SC/TN/14/3795 (P36435) dated 17.01.2023 within the time frame as directed by this Court. 2/6
3.The learned counsel appearing for the petitioner submitted that the erstwhile landowner M/s.Southern Petro Chemical Industries Corporation Limited executed lease deed dated 01.04.2004 in favour of Bharat Petroleum Corporation Limited from 01.06.2003 to 30.09.2025 in respect of the land situated in No.89, Anna Salai, Guindy, Chennai measuring an extent of 11,230 sq.ft. where the petroleum outlet is being run. Thereafter, Polyhose India Private Limited purchased the aforesaid land vide sale deed dated 29.03.2012.
The lease period expired on 30.09.2025 and communication was sent by the petitioner to the respondents 2 and 3 requesting to hand over possession of the property. 4.The learned counsel appearing for the petitioner further submitted that the petitioner made representation dated 30.09.2025 to the first respondent requesting to cancel petroleum license dated 17.01.2023 issued to Bharat Petroleum Corporation Limited, however, there is no response. Hence, this Court may issue direction to the first respondent to consider the petitioner's representation dated 30.09.2025, conduct enquiry between the petitioner and the respondents 2 and 3 and to pass appropriate orders, within a 3/6
reasonable time frame.
5.The learned Government Advocate (Crl. Side) appearing for the first respondent submitted that based on the petitioner's representation dated 30.09.2025, enquiry will be conducted between the petitioner and the respondents 2 and 3 and appropriate orders will be passed.
6.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representation dated 30.09.2025, on merits and in accordance with law, conduct enquiry between the petitioner and the respondents 2 and 3 and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order. 7.The writ petition is disposed of.
