ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 07.10.2025 for the offences punishable under Section 194 of BNS later altered into Section 103(1) of BNS in Crime No.210 of 2025, registered on the file of the respondent police, seeks bail. 2.

The allegation against this petitioner is that, he is a friend to the deceased and on the date of occurrence, they consumed liquor, thereafter a wordy quarrel arose between them, due to which the petitioner assaulted the deceased, strangulated him and pushed him into the dam, which leads to death of the deceased. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 07.10.2025; that the deceased fell down into the dam due to intoxication and the petitioner has not committed the murder of the deceased; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case, submitted that the post-mortem report indicates that there are injuries on the neck of the deceased body, to show that the deceased was strangulated and the final opinion in this regard is awaited; and that the investigation of the case is pending.

Considering the submissions made on both sides, grave nature of offence, taking note of the fact that the investigation of this case is pending and if the petitioner is enlarged on bail, there is possibility of hampering the investigation, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 31.10.2025 stn 3/4
