ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.10.2025 for the offences punishable under sections 123 of BNS, 2023 (old corresponding section 328 of IPC) in Crime No.355 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was found in possession of 1,000 numbers of Tapantadol Hydrochloride tablets and was arrested and remanded to judicial custody.

3. The learned counsel for the petitioner submitted that the petitioner has no previous cases, the contraband has already been seized, and the contraband seized is not falls within the schedule of NDPS Act. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reported that there are three accused in this case. The petitioner and other accused were importing tablets from Rajasthan through courier, and A1 in this case is yet to be apprehended, and the investigation still pending. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that a huge quantity of 1,000 tablets has been recovered and the petitioner has been in custody only from 3.10.2025, and A1 is absconding, I am not inclined to grant bail at this stage, as it would hamper the investigation.
