O R D E R
The present Writ Petition (Criminal) has been filed seeking a direction to the respondents not to interfere with the running of the petitioner's tea shop.
Learned counsel appearing for the petitioner submitted that the petitioner is running a tea shop in the name and style of "Tea Point" at No.13, L & T Toll Gate, Atthupalayam, Palakad Main Road, Coimbatore District - 641 008, after obtaining the necessary license and that 15 employees are working in his shop. However, the third respondent is insisting the petitioner to close his shop by 10.00 p.m. He further submitted that the petitioner's shop is located at a junction point frequently used by Kerala-bound and Palani-bound buses and that passengers passing through the area will avail refreshments during night hours. He also submitted that no adverse notice has been issued against the petitioner by the respondent Police. The petitioner has also sent a representation dated 17.09.2025 to the respondents seeking permission to keep his shop open 24x7. 2/5
In support of his contention, the learned counsel for the petitioner brought to the notice of this Court G.O.(D).No.207, Labour Welfare and Skill Development (K2) Department, dated 08.05.2025, wherein, it is stated that all shops and establishments employing 10 or more persons are permitted to remain open 24x7 on all days of the year for a period of three years with effect from 05.06.2025 subject to certain guidelines. Hence, he prayed for a direction to the respondents not to interfere with the petitioner's business.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, including G.O.(D).No.207, Labour Welfare and Skill Development (K2) Department, dated 08.05.2025, this Court directs the third respondent to consider the petitioner's representation seeking permission to run his shop 24x7, within a period of four weeks from the date of receipt of a copy of this order, provided the petitioner complies with the guidelines stipulated in the said Government Order. The respondent Police are directed not to interfere with the petitioner's business, except in the event of any law and order issue 3/5
arising therefrom, which may warrant initiation of criminal proceedings. 5.
With the above directions, this Writ Petition (Criminal) stands disposed of. No costs.
